Participation in the Promotion, “Outletcity Metzingen x Turkish Airlines Miles&Smiles” is conditional upon the following listed conditions: Participation in this promotion constitutes acceptance of the following terms and conditions:

1. Promoter

The Promoter of this promotion is OUTLETCITY AG, Hugo-Boss-Platz 4, 72555 Metzingen (Hereinafter: OUTLETCITY AG).

2. The Promotion

In the scope of this promotion, participating customers at Outletcity Metzingen, operated by OUTLETCITY AG, can earn Miles in Turkish Airlines’ Miles&Smiles Frequent Flyer Program (hereinafter: ‘Miles&Smiles Frequent Flyer Program’) for their purchases by shopping in person at a participating store or restaurant at Outletcity Metzingen and meeting the conditions set out in these terms and conditions. Purchases made in the Outletcity Metzingen online shop do not qualify for participation. This promotion is purely a Mileage-earning scheme, under which participants will be credited with 1 Mile for every 1 euro spent, provided the conditions are met.

3. Participation Requirements

Only individuals who are aged 18 or over at the time of participation, who hold a valid Miles&Smiles membership at the time of purchase and when presenting their receipt at the Welcome Centre at Outletcity Metzingen, Reutlinger Str. 58, 72555 Metzingen, and who can prove this by presenting their valid membership card, are eligible to take part.

Employees of OUTLETCITY AG, companies affiliated with OUTLETCITY AG, the City of Metzingen, Metzingen Marketing- und Tourismus GmbH, and employees of brand retailers at Outletcity Metzingen are excluded from taking part.

Participation is only possible in person and on site. Participation by third parties, the transfer of eligibility to participate, or redemption on behalf of another person is not permitted.

4. Participation Process

The participant makes a purchase at one of the stores or restaurants at Outletcity Metzingen listed here https://www.outletcity.com/en/metzingen/turkish-airlines/.

Within 14 days of purchase, the participant shall submit the original receipt at the Welcome Center of Outletcity Metzingen during the regular opening hours and shall present their membership card of the Miles&Smiles Frequent Flyer Program with membership being active at the time of purchase and during submission to the Welcome Center. An employee in the Welcome Center will check the receipt for plausability (date of purchase, store, amount) and will record the participant’s full name and membership number in the Frequent Flyer Program. OUTLETCITY AG nor its employees shall not verify the validity of the membership in the Miles&Smiles Frequent Flyer Program. This verification is the sole responsibility of Turkish Airlines. OUTLETCITY AG shall forward the recorded data to Turkish Airlines on a regular basis.

5. Miles Rewards

Upon fulfilling the requirements, the Participant shall receive 1 Miles&Smiles Mile for each 1 Euro spent (the gross amount based upon the receipt sum). Outletcity AG’s obligation to provide Miles credits to Miles&Smiles Frequent Flyer Programme members shall be in accordance with rules and regulations set from Miles&Smiles Frequent Flyer Program website (www.milesandsmiles.com) as published by Turkish Airlines and amended from time to time. Once OUTLETCITY AG has credited Miles to Miles&Smiles Frequent Flyer Program members, the Miles will be processed by Turkish Airlines into the Miles&Smiles member’s account within 8 weeks at the latest. 6. Maximum Limits and Restrictions

A maximum of 30,000 Miles per participant may be earned per calendar year as part of this promotion. Miles cannot be redeemed for cash and can only be registered to the Miles&Smiles member present in person. The Miles are intended solely for accumulation within the Miles&Smiles Frequent Flyer Program. OUTLETCITY AG reserves the right to exclude this offer from being combined with other promotions, discounts, vouchers or special terms.

7. Exclusion due to misconduct / suspicion of fraud

OUTLETCITY AG reserves the right to exclude participants from the promotion and to refuse to credit Miles if there is reasonable suspicion of fraudulent behaviour, manipulation, multiple entries under false identities, a breach of these terms and conditions, or any other form of abuse (suspected fraud). In such cases, Miles that have already been recorded but not yet credited may be declared void.

8. Validity of TERMS AND CONDITIONS for the Miles&Smiles program by Turkish Airlines

The contractual relationship between the participant and Turkish Airlines regarding the Miles&Smiles Frequent Flyer Program, the crediting of Miles, the redemption of Miles and the expiration of Miles shall be governed exclusively by Turkish Airlines Miles&Smiles Frequent Flyer Program Terms & Conditions of Participation, which are available at https://www.turkishairlines.com/en-int/miles-and-smiles/terms-and-conditions/. These terms and conditions shall take precedence over those of OUTLETCITY AG.

9. Right to Amend or Terminate the Promotion

OUTLETCITY AG reserves the right towards the Miles&Smiles member to amend, suspend or terminate the promotion at any time without prior notice and without giving reasons, insofar as this is necessary due to technical faults, legal requirements or other important reasons. Any entitlement to Miles credits already accrued for purchases made prior to the termination of the promotion and duly documented remains unaffected by this.

10. Limitation of Liability

OUTLETCITY AG shall have unlimited liability for wilful misconduct and gross negligence. In cases of simple negligence, it shall only be liable for breaches of material contractual obligations (cardinal obligations) and such liability shall be limited to foreseeable damage typical of the contract. Liability for omissions or other reasons attributable to the participant, in particular for financial losses arising from refusal, cancellation or withdrawal from participation in the programme, is excluded. OUTLETCITY AG remains responsible for the accuracy and completeness of crediting Miles to Miles&Smiles members. Once the Miles have been correctly credited, OUTLETCITY AG shall not be liable for the subsequent processing of Miles by Turkish Airlines Miles&Smiles Frequent Flyer Program. The above limitations of liability do not apply in the event of injury to life, limb or health, or in the event of the assumption of a guarantee or fraudulent concealment of a defect.

11. Governing Law, Jurisdiction, Severability Clause 

The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions of Participation shall be Metzingen, insofar as this is permissible. This applies in particular where the participant does not have a general place of jurisdiction in Germany. Legal recourse is not otherwise excluded.

Should any provision of these Terms and Conditions of Participation be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the statutory provision that most closely approximates the economic purpose of the invalid provision.
